Terms and Conditions
These Terms and Conditions ("Terms") govern your use of eTip, the electronic tipping platform for South Africa ("the Platform", "we", "us"), currently operated as a sole proprietorship trading as "eTip". By registering for or using the Platform, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 18 years old, and hold a South African mobile number that you control, to register for an account. Your mobile number identifies you on the Platform and is where eTips sent to you are directed, so it cannot be shared with another account.
2. Your account
You need a confirmed email address and a verified South African mobile number to hold an account. You are responsible for your password and for any activity on your account. Choose a password you do not use anywhere else. We will email you whenever your password changes, and whenever somebody attempts to register using your email address or mobile number - if you receive one of those and it was not you, contact us immediately.
3. Mobile number verification and WhatsApp
You may verify your mobile number by requesting a one-time code sent to you over WhatsApp or SMS. Verifying by WhatsApp means we send you an automated message using the WhatsApp Business Platform, operated by Meta Platforms, Inc.; your use of WhatsApp remains subject to WhatsApp's own terms, and we are not responsible for outages or delays on WhatsApp's side.
4. The eTip service
eTip lets people send and receive small electronic payments ("eTips") using a South African mobile number, without needing cash. Some features described on our website - including adding funds to a wallet, sending an eTip, and cashing out - are being rolled out in phases and may not yet be available to every account. Where a tip is sent to a mobile number that has not yet registered with eTip, we hold that amount on the recipient's behalf until they register and claim it.
Before any of these features go live for you, we will publish the specific terms that apply to them - including any fees, minimum or maximum amounts, and how long an unclaimed tip is held - and your use of that feature means you accept those terms.
5. Fees
Any fee we charge for using the Platform will be clearly shown to you before you confirm a transaction. We do not charge hidden fees.
6. Acceptable use
You agree not to use the Platform to:
- impersonate another person or provide false information,
- launder money or facilitate any unlawful transaction,
- attempt to interfere with or gain unauthorised access to the Platform, or
- use the Platform for any unlawful purpose.
We may suspend or close an account we reasonably believe breaches this clause.
7. Suspension and termination
We may suspend or close your account if we reasonably suspect fraud, abuse, or a breach of these Terms, or as required by law. You may close your account at any time by contacting us. Closing an account does not remove any obligation you already owe, or any right you already have, at the time it closes.
8. Our role and liability
eTip provides a platform to facilitate tips between users; we are not a bank, and any balance held is not a bank deposit. We do not guarantee the Platform will be uninterrupted or error-free. To the fullest extent permitted by South African law, our liability to you is limited to direct losses caused by our negligence or breach of these Terms, and we exclude liability for indirect or consequential loss. Nothing in these Terms limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.
9. Changes to these Terms
We may update these Terms as the Platform changes. We will post the updated Terms here with a new "last updated" date, and where a change materially affects you we will also notify you by email.
10. Governing law
These Terms are governed by the law of the Republic of South Africa, and any dispute is subject to the jurisdiction of the courts of South Africa.
11. Your information
